General conditions of Sale

The models and assembly kits presented on this website, which may be MILITIA MODELS branded as well as other brands, are always to be understood - intended for sale as UNPAINTED - unless otherwise expressly indicated in the individual product data sheet. If individual painted figures, dioramas or other compositions of various types are presented for sale on our platform, complete with base and all finishing accessories, they will always be accompanied by the name of the author (or authors), and will be understood as "special products" with a handwritten signature.

The contract stipulated between MILITIA MODELS and the Customer must be considered concluded with the acceptance, even if only partial, of the order by MILITIA MODELS. This acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions transcribed below.

If the customer is a consumer, i.e. a natural person who purchases the goods for purposes not related to his professional activity, once the online purchase procedure has been completed, he will print or save an electronic copy and in any case keep these general conditions of sale , in compliance with the provisions of the articles. 3 and 4 of Legislative Decree 185/1999 on distance selling.

Any right of the Customer to compensation for damages or compensation is excluded as well as any contractual or non-contractual liability for direct or indirect damage to people and/or things, caused by non-acceptance, even partial, of an order.

PURCHASE METHOD:

The Customer can only purchase the products present in the MILITIA MODELS electronic catalog at the time of placing the order and viewable at www.militiamodels.com as described in the relevant information sheets. It is understood that the image accompanying the description of a product may not be perfectly representative of its characteristics but may differ in colour, size and shape.

The correct receipt of the order is confirmed by MILITIA MODELS by means of a response via e-mail, sent to the e-mail address communicated by the Customer. This confirmation message will contain the order execution date and an "ORDER IDENTIFICATION CODE" to be used in any further communication with MILITIA MODELS. The message presents all the data entered by the Customer who undertakes to verify its correctness and promptly communicate any corrections, according to the methods described in this document.

In case of non-acceptance of the order, MILITIA MODELS guarantees timely communication to the Customer.

This catalogue, although the result of careful work, may be subject to errors. Therefore we cannot be held responsible for any transcription or compilation errors. If MILITIA MODELS finds any particular inaccuracies, it will contact the Customer to clarify any doubts.

RIGHT OF WITHDRAWAL:

Pursuant to art. 5 DL 185/1999, if the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating a VAT number reference in the order form to MILITIA MODELS ) has the right to withdraw from the purchase contract without any penalty, except as indicated in the following paragraphs.

To exercise this right, the Customer must send MILITIA MODELS a communication to this effect, within 5 days (natural and consecutive) from the date of receipt of the goods. This communication must be sent by e-mail or registered letter with acknowledgment of receipt addressed to:

or send an email to info@ militiamodels.com within 5 working days of receiving the goods informing us of your intention to exercise the right of withdrawal for the order (indicate the number). Once the notice of withdrawal has been received, MILITIA MODELS Customer Service will quickly communicate to the Customer the instructions on how to return the goods which must reach MILITIA MODELS within 10 days of authorization.

The right of withdrawal is however subject to the following conditions:

a) the right applies to the product purchased in its entirety, it is not possible to exercise withdrawal only on part of the purchased product;

b) the right of withdrawal does not apply to shipping costs;

c) the purchased good must be intact and returned in the original packaging, complete in all its parts.

d) in accordance with the law, the shipping costs relating to the return of the goods are borne by the Customer;

e) the shipment, until receipt is certified in our warehouse, is under the complete responsibility of the Customer;

f) in the event of damage to the goods during transport, MILITIA MODELS will notify the Customer of the incident (within 5 working days of receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier he has chosen and obtain reimbursement of the value of the property (if insured);

g) MILITIA MODELS is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments;

Without prejudice to any restoration costs for confirmed damage to the original packaging, MILITIA MODELS will refund the Customer the entire amount already paid, within 14 days. from the return of the goods, by bank transfer (based on bank information provided by the customer) or by PayPal to the customer's PayPal account.

The right of withdrawal is totally lost due to the lack of the essential condition of integrity of the goods.

PRIVACY:

The personal data relating to the purchase order are collected and processed in order to satisfy the express requests of the Customer and will under no circumstances and for any reason be transferred to third parties. The owner of the processing of personal data is MILITIA MODELS of Raffaele Piseddu which guarantees its Customers compliance with the legislation on the processing of personal data, governed by the privacy code referred to in Legislative Decree 196 of 06/30/03.

COMPLAINTS:

Any complaints must be addressed to MILITIA MODELS - Via Giacomo Boni, 10 - 20144 Milan

Complaints relating to the goods are accepted no later than 5 working days from receipt of the package (the delivery date declared by the courier is valid). For any report, please send us an email to info@militiamodels.com . Telephone complaints are not accepted. After the aforementioned deadline, no complaints will be accepted in any form.

Regarding any missing parts of the product, please send an email to info@militiamodels.com with the details of the missing parts (codes etc.) and attaching the images of the product. The MILITIA MODELS company will forward the report to the manufacturer and promptly respond to the customer as soon as the missing parts are delivered.

The sales contract between the Customer and MILITIA MODELS is intended to be concluded in Italy and regulated by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his municipality of residence. In all other cases, the territorial jurisdiction is exclusively that of the Court of Milan.

SHIPPING SERVICE FEATURES:

Rates

Rates are VAT excluded and include:

• Personalized package collection and delivery service.
• Information relating to shipment in real time, with provision of name, date and time of delivery.
• Compilation of labels, waybills and all documentation relating to the shipment.

Customs charges

Extra-EU foreign rates include shipping costs but NOT any applied VAT, charges, customs duties which remain the responsibility of the recipient.

Personal data

In order to successfully ship the goods purchased on our store's platform, it is essential to provide complete shipping and billing data when registering log-in or, in the case of an occasional customer, accurately providing the recipient's data (e.g. . country, street, city, post code, telephone, intercom, etc.)

Safety

Customers are informed that shipments may be subject to security checks according to national and international criteria and needs, including the use of X-ray systems, systems for identifying traces of explosives and other methods of safety check. By purchasing the product and the related shipping costs, the recipient accepts that shipments may be opened and their contents checked by the police.

Weight limits and measurements

Customers are informed that the shipping rates applied at the time of purchase are valid up to an overall shipping limit as shown below, beyond which a personalized extra-list rate will need to be applied:

Maximum length per package: 270 cm

Maximum weight of a single non-palletised package: 50 kg

Maximum size per package - 330 cm {sum of perimeter and length).

At the courier's discretion, the maximum measurement can reach up to 419 cm

It is also possible to ship pallets and cargo of different weights and dimensions once the actual transport needs have been verified and once a specific economic agreement has been concluded regarding "special transport" which goes beyond the rates applied in this shop.

Geographic shipping limits

Please note that the purchase and shipping service for goods is suspended to the following countries:

People's Republic of China, Russia, Belarus, Democratic People's Republic of Korea (North Korea), Sudan, Myanmar and Libya.

Covers

In the event of loss of the goods or failure to deliver by the Shipping Company in charge of the transport and delivery contract for the goods, MILITIA MODELS assumes the burden of a new shipment including every item purchased by the customer and never arrived at its destination.

ORDERS AND PAYMENTS:

To access the shipping services, there is a minimum order requirement of €17.00 (shipping costs excluded).

REGISTRATION - At the time of registration you will be asked for the data relating to the shipment of the goods. These data can be modified or deleted by you directly from your personal file. Furthermore, you will be asked for your email address and a password with which to access your personal profile and all reserved areas; for example, you can follow the status of your order by entering your access data (email and password chosen at the time of registration). If you lose your password, you can access the recovery page.

NAVIGATION - If you have just registered or if you have entered the site by entering your login details (email and password chosen at the time of registration) you have a virtual shopping cart at your disposal in which to insert the items you prefer simply by clicking on the "buy" button. You can also purchase multiple times, in fact the cart will keep in memory any items inserted in the previous links until the order is processed or until it is manually cancelled. Prices, availability and any offers may change until the order is confirmed.

HE CONFIRMS - When your purchases are finished, click on CHEK OUT and you will be presented with a summary of the order which you can eventually: a) modify by changing the quantity of some items or eliminating some items; b) check the shipping data and choose whether to modify such data; click on NEXT and you can continue shopping or confirm the order. Once your order has been confirmed, you will be sent a reminder email, and your order will be processed as quickly as possible. We recommend that you print and keep the copy of your expense that was sent to you via email.

SHIPPING AND TRACKING - Your order will be shipped as soon as possible. If all the goods are in stock, MILITIA MODELS ships within 3 working days. No shipments are made on Saturdays, public holidays and in particular periods of the year such as national and religious holidays.

You can follow the progress of the order via the internet by accessing the site with your login details (email and password chosen at the time of registration) and entering the order summary section. MILITIA MODELS ships via MBE express courier and the indicative delivery times are as follows:

a) for large centres, one working day; b) for small towns and provinces, 24/48 hours; c) for Calabria, Puglia, Sicily and Sardinia, 48/72 working days.

The courier makes 2 delivery attempts. Please enter a delivery address where someone is present during office hours to collect the shipment. A telephone number where you can be reached is also essential, as the courier does not agree on delivery times and/or days. After the second delivery attempt, the package is returned to the sender. If the package returns to the sender because the recipient is absent, or due to a lack of data in the address, and you wish to receive the goods again, we will be forced to charge you double shipping costs, in addition to the costs incurred for storage, the amount of these costs may vary over time. If you are no longer interested in the goods, you will still be charged for the costs incurred (shipping and storage).
